Tata Kelola Demokratis: Pemanfaatan Kedaulatan Rakyat dalam Memerangi Korupsi

Abstract: This research explores the relationship between the concepts of the Rule of Law, Democracy, and Corruption in Indonesia. Using the Normative Legal Research method, it relies on secondary data sources such as books, journals, and relevant articles to analyze the connection between these concepts. Through conceptual and philosophical approaches, the research examines experts' views and analyzes legal aspects related to the Rule of Law, democracy, and corruption cases. The findings highlight the importance of people's sovereignty in shaping laws aligned with democratic principles, while cautioning against the dangers of misinterpreting laws that could harm society. This study demonstrates that law enforcement concerning corruption must consider democracy's essence as a tool to serve the needs of the people, rather than being the ultimate goal in the state's structure. Keywords: Democracy, sovereignty, people, corruption. Abstrak: Penelitian ini mengeksplorasi hubungan antara konsep Negara Hukum, Demokrasi, dan Korupsi di Indonesia. Dengan menggunakan metode Penelitian Hukum Normatif, penelitian ini mengandalkan sumber data sekunder seperti buku, jurnal, dan artikel terkait untuk menganalisis hubungan antara konsep-konsep tersebut. Melalui pendekatan konseptual dan filosofis, penelitian ini mengulas pandangan para ahli serta menganalisis aspek hukum yang terkait dengan negara hukum, demokrasi, dan kasus korupsi. Temuan menyoroti pentingnya kedaulatan rakyat dalam membentuk hukum yang sesuai dengan prinsip demokrasi, sambil memperingatkan tentang bahaya kesalahan interpretasi hukum yang dapat merugikan masyarakat. Penelitian ini memperlihatkan bahwa penegakan hukum terkait korupsi harus memperhatikan esensi demokrasi sebagai alat untuk melayani kebutuhan rakyat, bukan sebagai tujuan akhir dalam tatanan negara.
