Transnational family and the right to inherit in Cuba: a project to debate

This article argues the existence in Cuba of the transnational family and present that the new Family Code must fully restore the inheritance rights of emigrated Cuban citizens, who are still governed by legal provisions prior to the decade of the 1990s century which don't correspond to the current evolution, motivations and peculiarities of international migration from Cuba, the reforms introduced by the Government in its migration policy, the prevailing perception in society about the act of emigrating and the constitutional postulates in force since 2019. The pertinence of repealed the article 470 of the Civil Code by the new Family Code, project that will be submitted to a popular referendum, is based on the substantial reform that it make about the Civil Code, particularly in relation to the successories incapacities and the need to eliminate the limitations that emigrated Cuban citizens have to inherit their relatives who remain in Cuba, due exclusively to their migratory status.
