摘要
This paper explores how law and jurisprudence are currently being challenged by anti-racist critiques. Specifically, it examines how the term „whiteness“ is being used to criticize law as inherently unjust and racist. Whilst the paper also addresses negative effects of the law, it mounts a defense of law and jurisprudence. It argues that true emancipation from racialized discrimination lies not beyond law and the Western legal tradition but rather through it. The promise of a universal and equal law for all should be reaffirmed, not abolished. That entails not losing sight of the ultimate goal of anti-racist thought and practice - the abolition of race in all its shapes from our world. Keywords: critical legal theory - law and race - legal dogmatics
